Customers
1. Acceptance of Terms - By placing an order on Foodmagic, you agree to these Terms of Use. - Foodmagic may update these terms from time to time; continued use of the platform means acceptance of the revised terms.
2. Eligibility - Customers must provide accurate contact and delivery information. - Use of the platform implies responsibility for ensuring that orders are placed with proper consent (e.g., by a parent/guardian if applicable).
3. Ordering & Payment - Orders must be placed through the Foodmagic platform. - Prices displayed include applicable taxes and delivery charges unless otherwise stated. - Payments are processed securely via Foodmagic’s payment system. Cash on delivery may be available depending on seller policy.
4. Delivery - Delivery times are estimates and may vary depending on seller location, traffic, and availability. - Customers must be available at the delivery address during the agreed time. - If delivery fails due to incorrect information or unavailability, the order may be canceled without refund.
5. Food Safety & Responsibility - Foodmagic connects customers with independent sellers (caterers, home cooks, restaurants). - Sellers are responsible for food preparation, safety, and quality. - Customers with allergies or dietary restrictions must review ingredient information before ordering.
6. Cancellations & Refunds -- Customers may cancel orders within 2 hours of placing them, subject to seller approval. - Once an order has been confirmed by both the seller and the customer, any cancellation will be at the seller’s discretion. - If a refund is approved after confirmation, 10% of the order value will be deducted to cover processing and service costs. - Refunds are issued only for undelivered, incorrect, or unsafe food, as determined by Foodmagic’s dispute resolution process. - Repeated misuse of cancellations may result in account suspension.
7. Customer Conduct - Customers must treat sellers, delivery partners, and Foodmagic staff respectfully. - Abusive behavior, fraudulent activity, or misuse of the platform may lead to account termination.
8. Platform Liability - Foodmagic acts as a marketplace and is not directly responsible for the food provided. - Foodmagic is not liable for health issues, delays, or disputes arising from seller services, but will mediate complaints fairly. - Customers agree to indemnify Foodmagic against claims resulting from misuse of the platform.
9. Privacy - Customer data (name, contact, delivery address) is shared only with sellers and delivery partners for order fulfillment. - Foodmagic will not sell or misuse customer data and will comply with applicable data protection laws.
10. Governing Law - These terms are governed by the laws of Sri Lanka. - Any disputes will be resolved under Sri Lankan consumer protection and e-commerce regulations.
